Kanye West wins “stronger” court case

[DS]: Kanye West has won a copyright theft court case after citing Frederick Nietzsche as his defence.

The rapper has been taken to court for supposedly plagiarising Vincent Peters’s song ‘Stronger’ in his song of the same name, after Peters gave a cassette tape of the track to West’s manager John Monopoly.

NME reports that the ‘All of the Lights’ rapper has won his case, after a judge rejected Peters’s claims.

Judge Diane Wood claimed that the songs did not sound similar, and agreed with West’s lawyers’ assertion that both songs were primarily influenced by the work of German philosopher Nietzsche, who coined the phrase featured in both songs, “That does not kill us makes us stronger”.

Wood ruled that the phrase had been cited and referenced in too many other works for Peters’s claim to be awarded, and specifically cited Kelly Clarkson’s track ‘What Doesn’t Kill You (Stronger)’.

In a closing summation, Wood noted: “Although the fact that both songs quote from a 19th century German philosopher might, at first blush, seem to be an unusual coincidence, West correctly notes that the aphorism has been repeatedly invoked in song lyrics over the past century.

“Notably, an even more recent popular song – one that held the top spot in the Billboard Hot 100 chart ['What Doesn't Kill You (Stronger)'] at about the same time as oral arguments in this case – also shares this key feature with both West’s and Vince P’s songs.”

West is currently working on his new album, and is rumoured to be in contention for a position onAmerican Idol as a judge.
